These legal conditions regulate the use and conditions of access and contracting of the website filament2print.com (hereinafter "Web" or "Filament2print"), a website owned by Dativc S.L..
1.1. In accordance with Law 34/2002, of July 11, and other applicable legislation, we inform you that this website filament2print.com is owned by the entity with the social denomination Dativic S.L. and CIF ESB70460423.
1.2. This entity has its registered office at Polígono Industrial Porto do Molle Nave 7A, 36350 – Nigrán (Pontevedra), Spain.

1.4. Unless expressly stated otherwise, communications with Dativic S.L. may be made by regular mail at the physical address or by email. The entity will contact the user via email, at the address held in its records or provided for this purpose.
1.5. The General Conditions described below regulate the conditions of use and access to the Web by any visitor (hereinafter, "User") and the contracting of the products offered on the Website (hereinafter, "Product" or "Products") by any User through the Website (hereinafter, "Customer"). The use or access to this web implies that the user acknowledges having read and understood these legal conditions of use and agrees to fully comply with them.
1.6. Users of the website to acquire the status of Customers and, therefore, purchase the Products, must complete an identification and registration form, accepting these General Conditions and all following the instructions they will receive through the website itself.
2.1. Dativic S.L. reserves the right to modify, at any time, unilaterally and without prior notice to its users, the content, structure, operation or access conditions of this website.
2.2. However, website users are aware and accept that part of the information contained in it may be incorrect, incomplete or outdated, or contain typographical errors. In addition, Dativic S.L. only assumes responsibility for content in Spanish, as the content in other languages is treated as automatic translations and not fully reviewed.
2.3. Likewise, Dativic S.L. reserves the right to temporarily suspend, without prior notice, access to this website for maintenance, updating, improvement or repair operations.
2.4. It is prohibited for the user to use this website to send, transmit or publish any illegal, threatening, defamatory, libelous, propagandistic, scandalous, obscene, pornographic, or any other material that could give rise to civil or criminal liability under applicable law, facts for which the user will be responsible in any case.
2.5. Generally, only individuals and legal entities with sufficient legal capacity according to applicable law may use this website. Exceptionally, minors who have obtained prior authorization from their parents or legal guardians, who will be responsible for the use that the minor makes of the site, may use the site.
3.1. The Customer and the User of Dativic S.L. agree to make appropriate and lawful use of the Web, in accordance with applicable legislation and these General Conditions.
3.2. Misuse of the Web is prohibited. The Customer and/or User must refrain from, among other things:

3.5. Dativic S.L. does not assume any duty or commitment to verify or monitor the content and information entered by users.
3.6. In any case, the user must always provide truthful information that cannot lead to any kind of confusion, as well as correct identification data, never impersonating third parties or on their behalf.
3.7. Our materials and products may be used by users at their own risk. To the maximum extent permitted by applicable law, we hereby disclaim any and all responsibility, risk, liability, and damages arising from any death or personal injury resulting from the use of our products and materials. Specifications are subject to change without notice. Dativic S.L. is not responsible for the consequences and damages that may result from improper use of the Products sold through the Web.
4.1. The use and access to the Web by the User and/or Customer implies acceptance of these General Conditions.
4.2. The Customer expressly accepts these General Conditions in the contracting process.
4.3. Dativic S.L. is not responsible for the temporary non-compliance with these General Conditions in case of force majeure and in case of the fault of the User or an unforeseeable event by a person outside the contract.
4.4. The Customer and/or User agrees to fill in the order forms and any other form, according to the indicated instructions and truthfully. The Customer also agrees to pay the price of the Product, including the corresponding taxes and shipping costs, always according to the final offer received from Dativic S.L.
5.1. Dativic S.L. offers a description of the Products included on the Web according to the technical descriptions from manufacturers and suppliers in general. It also includes information on the trade name, brands or distinctive signs of the Products to provide the maximum possible information to the User.
5.2. Please read the Product descriptions carefully before deciding to purchase them. The images shown may differ slightly from the final Product. In case of doubt, contact us before making the purchase.
5.3. The values of the filters available in the product listings are indicative and not binding, as they are intended to facilitate the search for products by different variables. To consult the official values of any product feature, it is recommended to review the manufacturer's technical sheet.
6.1. All orders are subject to our acceptance. Within 24 hours after placing the order, we will send an email confirming that the contract has been concluded (hereinafter, "Order Confirmation"), provided that the Customer has provided us with their email address in their personal data form. The Order Confirmation will include the confirmation of the Customer's prior express consent and inform them of the loss of the right of withdrawal, when applicable.
6.2. In the exceptional circumstance that we are unable to send you any of the products in your order, we would proceed to replace it with one of identical or superior characteristics, notifying you of this circumstance by email and noting the change made in your order. In case of doubt or unavailability of a substitute, we will deduct the product from your order and proceed with the shipment as well as the refund of the undelivered product.
6.3. The deadline to cancel or modify an order ends when the order status changes to "Shipped". From that moment, the order will have been transferred to the carrier for shipment, and the purchase will have become a sales contract to which both parties are subject to compliance, the user as the recipient of the goods, and the Web as the seller, with the shipping and service conditions set forth in these terms of use.
6.4. The products comply with current Spanish legislation. Dativic S.L. will not be responsible in case this does not coincide with the legislation of the country where the products are delivered. It is the responsibility of the User to request information from local authorities about the possibilities of importing and/or using the requested products.
7.1. An order can be canceled at no cost before it begins its "Preparation in process" phase in our warehouse or enters the "Order in process" status in the case of products requested on demand. If at the time of delivery the customer decides to reject it, they must bear the shipping costs generated by the shipment.
7.2. Order extension. Items can be added to an order as long as it has not been shipped. The customer will pay the amount corresponding to the result of the modification.
7.3. Item removal. Items can be removed from an order as long as it has not been shipped or is in the "Order in process" status.
7.4. In the case of order modifications, it may result in a modification of the total amount, which is subject to an additional shipping cost charge if the minimum stipulated is not reached, as well as the elimination of these costs if the total amount is equal to or greater than the minimum indicated on the web.
8.1. In the contracting process, the User will accept the total price when clicking the "Pay" button.
8.2. Product prices may vary but will not affect orders for which the Order Confirmation has already been sent.
8.3. Dativic S.L. reserves the right to charge the order from the Order Confirmation.
8.4. The sale prices of the Products indicated on the Web are shown with and without VAT. If the customer lives in the European Union, they must pay Spanish VAT unless they validate a registered VAT Number (VIES) during the purchase process. For customers outside the European Union, final prices will always be without Spanish VAT.
9.1. At Filament2print we offer various payment methods, detailed on the Payment and financing page.
9.2. For any order whose amount exceeds a threshold set by Dativic S.L., the User will be asked for an identity document and a proof of address, which must be sent to the email address indicated.
9.3. The payment of an order or invoice will not be linked to the proper functioning of the product. The payment and due date of an order will be marked in any case by the issued invoice, and it will not be a reason for delay if the product has any fault or incident, as this would enter the warranty process.
10.1. Filament2print will deliver the Products to the Customer at the delivery address provided in their personal data form.
10.2. Hours and days are understood to be business hours and days, excluding Saturdays, Sundays, and holidays. If for any reason attributable to Filament2print this period is exceeded, we will communicate the incident to the Customer and propose alternative solutions.
10.3. The estimated delivery date will be the result of the sum of the availability of the item indicated on the web, within the product's description, as well as the delivery period, depending on the chosen transport service. This date may be altered in case of an incident with the products, as well as during the transport service. In any case, a solution will be sought for the customer.
10.4. Once the order has been paid for, it is not possible to modify the transport service.
10.5. The Customer agrees that they or a designated person will be at the indicated address to receive the package. Our logistics providers make up to three delivery attempts. In case of repeated failed delivery attempts, the order will be returned to our facilities, with the consequent refund to the Customer of the payment made minus the shipping or return costs of the Products.
10.6. The risk of the Products will be transferred when the Customer acquires material possession of the Product.
10.7. Filament2print ships to any country. Shipping costs vary depending on the order. They depend on four factors: weight, volume, shipping location, and purchase amount.
10.8. Shipping costs are not included in the price of the products but are added during the purchase and appear itemized in the purchase summary. Certain products may incur additional shipping costs due to logistical peculiarities and insured shipments. On the Shipping and Delivery page, the different shipping options according to the destination territory are shown.
10.9. Regarding delivery address modifications; due to the rapid delivery time, if the order has already been shipped, you must contact the shipping company directly and, using the tracking code we provide, make the necessary arrangements, if possible.
10.10. All times mentioned regarding processing, shipping, and delivery are only a reference to be taken into account as such and may vary depending on the workload of the logistics warehouse, transport incidents, or due to force majeure.
10.11. The recipient is obliged to immediately examine if the shipment presents any damage and if it is complete. In case of detecting any damage at the time of delivery, it should be noted on the delivery note provided by the carrier so that the company can process the incident, not being able to process an incident afterward. Damages that may have occurred during transport and cannot be externally examined must be communicated to us in writing within a maximum of 24 working hours from the receipt of the order.
10.12. Shipments to destinations outside the European Union are made under the DAP modality (more information on the Shipping and Delivery page). Therefore, the shipping costs applied to the order do not include customs expenses (if any) or possible import management costs by the customs agent. These costs are variable and depend on each destination country, so they must be paid by the customer (in non-EU countries or areas with special tax restrictions). By accepting these purchase conditions at the time of order confirmation, the customer agrees to pay these expenses. It is possible to consult with the customs authority of the territory the amount of expenses based on the HS Code of the merchandise (available on the invoice). It will be the buyer's responsibility to pay the taxes and customs duties that apply to the order. Filament2Print is not responsible for the cost of customs, nor for the delay that may be caused in the delivery of the package. A return of an order due to this cause will not be accepted, except for an error committed by Filament2Print. In case of rejection of the import duties and customs expenses necessary to make the delivery of the order, the transport company will return the merchandise to origin, generating additional costs (return shipment, export DUA...) which will be borne by the customer, deducting these amounts from the refund issued once the return is processed.
10.13. It is recommended to keep the original packaging of the equipment, as it will be required in cases where the warranty process needs to be executed.
11.1. All Products offered by Filament2print have the legally provided warranty. We commit to the repair of the product (if possible), replacement with a new one, or making the corresponding refund if any of its Products has a manufacturing defect within the corresponding legal warranty period, although proof of the defect must be provided as specified in section 11.5. In this case, all return costs of the Product and shipping of the new Product or the same repaired one are borne by Filament2print. In the case of 3D printers sold in kits (i.e., requiring assembly or mounting), it should be clarified that this article refers to manufacturing defects of any component, not including defects or problems arising from its assembly by the customer.
11.2. Unless proven otherwise, the delivery is understood to be made on the day stated on the invoice or delivery note, if later.
11.3. For the warranty to be effective, proof of purchase must be presented within the legally established period.
11.4. The consumer must inform of the lack of conformity of the Product within one month from when they became aware of it via email.
11.5. Unless proven otherwise, it will be presumed that the lack of conformity that manifests itself in the month following the delivery of the Product already existed when it was delivered, except when this presumption is incompatible with the nature of the Product or the nature of the lack of conformity.
11.6. There is conformity of the Products with the contract and, therefore, Filament2print will not be responsible for non-conformities when the Products included on the website:
11.7. Likewise, Filament2print will not be responsible for non-conformities that the Customer knew or could not have ignored at the time of contract formation.
11.8. The Customer may demand the repair of the Product, its replacement, a price reduction, or the termination of the contract if the Product is not in conformity with the contract. The action to demand compliance with the above will prescribe three years from the delivery of the Product.
11.9. The price reduction will be proportional to the difference between the value the Product would have had at the time of delivery.
11.10. The warranty does not include damage caused by negligence, impacts, improper use or handling, improper storage, unsuitable voltage, electrical accidents, installation and/or use not in accordance with the instructions for use or not carried out by the authorized technical service when applicable, or perishable materials or Products, subjected to wear due to normal use or consumables. Filament2Print will not be responsible for possible costs of damages and losses or lost profits that the Customer may incur.
11.11. The following are excluded from the warranty:
11.12. In this way, we can decide, at our discretion, not to repair or replace the Product or refund the amount paid and/or request the reimbursement of all transportation and review costs incurred according to current standard rates. To carry out this reimbursement, we may charge the mentioned costs to your credit or debit card account or use the payment details provided when placing the Order. To the extent permitted by law, we are not responsible for any losses, liabilities, costs, damages, or expenses that may result from the process.
11.13. The customer will bear possible shipping costs if it is necessary to send the equipment for evaluation by Filament2Print or the manufacturer. If, after this evaluation, the warranty applies either for repair or replacement of the equipment, these costs will be compensated to the customer. The shipment to the facilities of Filament2Print or the manufacturer will require prior authorization from Filament2Print.
11.14. Warranty claims will not be made as a means for the Customer to obtain training on the product or any information related to the use of the product, as such services are not related to the warranty and may incur charges for such services.
12.1. A product can be returned, provided it has not been used and is in perfect condition, in accordance with current legislation within 14 calendar days from the day of receipt. Products must be in perfect condition and accompanied by their corresponding proof of purchase.
12.2. It should be noted that there are certain products that, due to their characteristics, cannot be returned, such as unsealed consumables. Due to the impossibility of verifying use, electronic components cannot be returned or exchanged. Products requested on demand and custom-made cannot be returned either.
12.3. Returns can be requested through the customer's user account on Filament2print.com, accessing the order history and selecting the order you wish to return partially or completely, explaining the reason for the return request. You can also request a return by communicating it in writing via email to [email protected].
12.4. Our customer service will then assess if the reason for the return request meets the return conditions and will contact the customer to continue the process. If the return is accepted, the customer service will assign a return number and request the shipment of the goods to our facilities.
12.5. The cost of shipping the products for return must be borne by the customer (unless the return is due to receiving a damaged product or incorrect delivery, in which case the return costs will be borne by Filament2Print). The customer can send the products by their means or request Filament2Print to manage the return transport. In this case, the customer will be informed of the transport cost, which will be deducted from the final refund amount.
12.6. When we receive the product(s) in our warehouse and verify that they meet the return conditions, the amount of the goods will be refunded within 14 calendar days following the receipt of the goods using the same payment method selected when making the purchase (if the payment was made by transfer, we will request the customer's bank details to proceed with the refund).
12.7. After reviewing the products subject to return, Filament2print reserves the right to reject the return if the aforementioned conditions are not met.
12.8. In case of having enjoyed the free shipping promotion for orders through the website, and provided that the return is not due to causes attributable to Filament2Print, the original shipping value of the order will be deducted from the refund amount.
12.9. As proof of the refund, we will issue the corresponding rectified invoice with your data and the indication of the article being refunded and the reference of the order to which it corresponds.
12.10. Amounts paid for customs clearances and customs duties will not be refunded. These fees are imposed by the corresponding Administration and do not depend on Filament2Print.
12.11. If you wish to exchange an item purchased for a different one available in the Filament2Print catalog, you must return the product in question and place a new order for the desired new product, as they are two independent processes.
12.12. Failure to pay customs duties and import costs necessary to deliver the order to the customer's address will not constitute a valid reason for return. If the customer refuses to pay the amount required by the shipping company to deliver the order, the return shipping costs to our facilities will be borne by the customer, deducting this amount from the merchandise refund. If the merchandise order amount is not sufficient to cover these charges, Filament2Print reserves the right to demand the necessary amount from the customer.
13.1. Do not share your personal information: Filament2print.com will never send you an email or call you to ask you to disclose or verify your Filament2print.com account password, bank account or credit card numbers, or any other personal information. If someone contacts you or you receive an unsolicited email asking for any of the above information, do not respond and immediately report it to Filament2print.com so we can investigate the incident.
13.2. Identify fake emails (Spoofing or Phishing attempts): Ignore any email you receive asking for personal information or directing you to a website other than Filament2print.com, or requesting you to pay outside of Filament2print.com, as it may be an attempt at identity theft ('spoofing') or 'phishing', and you should consider it fraudulent. Filament2print uses the endings "@filament2print.com" for emails. If you receive an email with a different format, you can be sure it is a fake email. Some phishing emails contain links to websites that use the word "filament2print" in their URL but will direct you to a completely different website. If you hover over the link, you can see the associated URL, which will likely have a different format than those linked to authentic Filament2print websites. If you still click on a phishing email and are redirected to a page that looks like "Your profile" or any page asking you to verify or modify your personal information, ignore it and consider it fraudulent.
13.3. Protect your password: Passwords are case-sensitive, and it is recommended that they contain a minimum of six characters. Adding numbers or special characters will make your password harder to obtain or guess. If you use a public computer (in libraries, cyber cafes, etc.), always remember to log out of Filament2print.com once you have finished.
